These terms apply to everyone who attends or takes part in events arranged by Drive Collective (“DC”), operated by UR Inc Ltd (company number 14284294). By booking an event you confirm that you have read and accept them, for yourself and any passenger you register.

1. Introduction

I understand and agree that:
1.1 the purpose of the event is to allow participants to enjoy a driving holiday or event in their own vehicle and to socialise with fellow members throughout the trip or event;
1.2 breaking driving laws, racing or timing of any kind during the event is prohibited;
1.3 all driving activities, including track day events, are potentially hazardous, and all participants are expected to obey the laws relating to vehicle condition and driving;
1.4 by participating in this event (whether as a driver, passenger, spectator or otherwise) I am voluntarily exposing myself to the risk of damage, loss, death or personal injury;
1.5 any insurance that may be carried by (i) DC, (ii) the event operator or owner, and/or (iii) other participants or myself in respect of any liability arising out of the event will be limited;
1.6 my motor insurance providing third-party and public liability cover on public roads may not cover my losses, liabilities or personal injuries arising from participation in the event, and it is my responsibility to verify this before the trip;
1.7 specialist insurance products are available that can cover: damage to my own car; damage to third-party property (including other participants’ cars and, for track days, trackside furniture and equipment belonging to the venue operator or owner); myself (personal injury or death); and other people (injury or death caused to third parties, including other participants, DC officials or employees of the event operator or owner).

2. Participation

Whilst attending or participating in this event, I will:
2.1 attend any compulsory briefing given by or on behalf of DC and, before setting out each day, familiarise myself with all local regulations applicable to the area (including when abroad);
2.2 at all times obey any written or verbal rules or instructions given to me by a DC official;
2.3 not leave the planned route or overtake the lead vehicle when on a group drive;
2.4 be responsible for my own conduct and standard of driving at all times;
2.5 accept that I am taking part at the same time as other participants, over whose conduct and standard of driving DC has no control;
2.6 satisfy myself (by route and map research or otherwise) before taking part in any activity that the route is acceptable to me with regard to its features, condition and layout;
2.7 only carry passengers who have been registered with and approved by DC in advance;
2.8 drive only my own car, and not drive anyone else’s car unless there is evidence of fully comprehensive insurance covering me to do so;
2.9 make sure any passenger or guest accompanying me is made aware of the risks involved and agrees to abide by these terms.

3. Disclaimer and indemnity

In consideration of being permitted to attend and participate in this event as a driver or passenger, I will indemnify and keep harmless DC, its directors, officials, representatives, agents and employees (each and every one of them) from and against all actions, costs, expenses, claims and demands in respect of any loss of or damage to property of myself or others, or injury (fatal or otherwise), arising out of or in connection with my attendance at or participation in the event, or that of any of my guests, which is caused by my own failure to comply with these terms (or any of them) and/or by my own negligence.

4. Declaration and warranty

I declare and warrant that:
4.1 I have read and will, throughout all events, comply with the DC Operating Procedures document issued by DC (where applicable);
4.2 any car I am responsible for and which will be used on the trip has been checked by me and/or a professional mechanic to ensure it complies with any regulations applicable to this event, and is fit for use, in good mechanical condition and capable of safe operation on the road and at events. DC strongly advises that cars are professionally inspected and set up before any trip or track day;
4.3 I understand DC will not inspect every participating vehicle, but reserves the right to inspect any vehicle, judge whether it is fit for purpose, and restrict or prevent its participation, for the safety of all members, participants and the public and in line with DC’s insurance requirements;
4.4 I am in sufficient health and fitness, and my eyesight (with glasses or lenses if worn) is adequate for participation in this event;
4.5 I will not participate whilst under the influence of alcohol or drugs, or if I feel unwell or tired;
4.6 I will wear a seat belt or harness, and when on track a properly fastened full-face helmet and appropriate protective clothing (including arms and legs fully covered);
4.7 I have the relevant driving experience;
4.8 I hold valid fully comprehensive insurance covering my vehicle in the event of an accident;
4.9 I hold suitable breakdown cover for my vehicle (including European cover for trips abroad);
4.10 I hold a full, valid DVLA driving licence or recognised international equivalent, and possess a standard of driving experience and competence appropriate for this event;
4.11 I will not share my membership with anyone else;
4.12 I will not invite others to DC meetings or events without first consulting a DC representative.

5. General

5.1 Nothing in these terms excludes or limits DC’s liability for death or personal injury caused by its own negligence, or any other liability that cannot be excluded or limited by law.
5.2 If any part of these terms is held to be ineffective or unenforceable, whether under the Unfair Contract Terms Act 1977, the Consumer Rights Act 2015 or otherwise, the remaining parts shall remain in full force and effect.
5.3 DC may suspend or cancel my event attendance or membership at any time if any of these terms are broken.
5.4 Personal details I provide will be used by DC only to administer events and membership and to contact my emergency contact if needed, in line with our Privacy Policy.
5.5 By booking, I acknowledge that I am entering into a legally binding agreement between DC (UR Inc Ltd) and myself governing my attendance at and participation in the event, and any liabilities arising from it.
